准入前国民待遇和负面清单管理的国际投资新规则对我国利用外资的启示

The Enlightenment of the New Rules of International Investment to China's Utilization of Foreign Capital:Basing on the Administration of Pre-establishment National Treatment and Negative List

"准入前国民待遇+负面清单"这一新的模式,越来越在世界范围内的外国投资领域变得越来越"热门",国家之间的贸易和投资安排正越来越多地使用这种方式。中国也在积极探索和实践新模式的外资管理——"准入前国民待遇+负面清单"制度,并以上海自由贸易实验区为试验点,层层推进。本文探讨了"准入前国民待遇+负面清单"外资管理模式的法律要求及其与WTO相关规则的差异,并提出了这种规则对我国利用外资的启示。

The new model of Pre-establishment National Treatment and Negative List, which is becoming more and more popular in the field of foreign investment in the world, is increasingly being used in the trade and investment arrangements between countries. China is also actively exploring and practicing this new model of foreign capital management and aims at promoting it nationwide through the China（Shanghai） Pilot Free Trade Zone. In this article, we have explored the legal requirements of the foreign investment management model of ＂Pre-establishment National Treatment ＋ Negative List＂ and compared its differences with the rules of WTO. At last we put forward some enlightenment of China＇s utilization of foreign capital.
