对制定《社区矫正法》的几点思考

Reflections on Community Correction Law

《社区矫正法》的制定应当彰显行刑轻缓化和行刑教育化的指导思想,并确立教育刑罚观的主导思想。社区矫正工作应遵循三个原则,即监督管理和教育帮扶相结合的原则、适当引导社会公众参与的原则、维护公共安全与保障个体权益相统一的原则。社区矫正工作应构建四个制度,即有效的工作衔接制度、健全的检察监督制度、规范的执法制度和区别对待制度。通过制定指导思想、明确工作原则和建立工作制度,我国的社区矫正工作必将取得长足进展。

The formulation of Community Correction law should show the guiding ideology of lightness of execution and education of excecution, and establish the education-oriented punishment notion . Works of community correction should be based on three working principles, namely, combination of supervision with education, permission of public participa- tion and coordination of public security and individual interest. Meanwhile, community correction work should build four working systems： effective work connection system, sound procuration and supervision system, normative enforcement system and differentiated treatment system.
