高通案评介与反思——从标准必要专利权滥用的反垄断法规制切入

高通案中,国家发展和改革委员会严格遵循"相关市场界定—市场支配地位认定—滥用市场支配地位行为认定—法律责任承担"的一般规制路径,同时充分考虑标准必要专利的特殊性,对高通公司的违法行为做出了准确认定。高通案对探索我国反垄断行政执法如何带动后续私人民事救济有一定的启发意义。同时,我国应尽快出台和落实反垄断法配套规范,为反垄断执法工作提供更为清晰的指导。
