摘要
法治社会是服从规则的治理,法治教育则是让规则铭刻在公民心中的教育实践活动。普法教育侧重于知识教育,是工具理性主导的对象化教育,强调法律知识的输入而忽视了理性行为的输出。当代法治教育应该是建立在交往理性基础上的价值教育,将受教育者视为主体,致力于教化人心,通过培养法治意识与法治理念,进而影响公民的日常行为。法治教育的具体目标则是培养民众主体意识,实现法治价值认同,培育其法治精神,内化于心外化于行,进而实现法治社会有序运行。
A rule-of-law society is to obey the rules of governance; The law-related education is the educational practice that engraves rules in the hearts of the citizen. Popularizing-law education focuses on knowledge education, which is object- oriented education derived from instrumental reason, emphasizing on inputting the legal knowledge and neglecting output of rational behavior. Contemporary law-related education should be value education established on the basis of communicative rationality, which see educates as the subjects, and is committed to civilize people, and affects citizens' daily behavior through cultivating the idea of rule of law. The law-related education's goal is to raise the subject consciousness of public, legal identity, cultivate the spirit of the rule of law, so as to realize the rule-of-law society.
