Comparative Study on International Convention for Transport

在经济全球化背景下,海运、民航和铁路运输的国际化发展态势逐步增强,签订国际公约成为规范各交通方式国际运输活动的主要手段。在"一带一路"国家战略形势下,法治化成为中国提升国际规则话语权的需要。在分析交通运输国际公约体系的基础上,对海事、民航、铁路国际公约进行比较,并从国家领土主权、运输过程安全性、交通工具国籍、法律范畴等方面研究国际公约的差异性,为交通运输领域国际化发展提供研究咨询参考。

Under the background of economic globalization,the international development trend of shipping,civil aviation and railway transportation is continuously increasing,therefore,signing the international convention becomes an important way to normalize the international transport activities for each transport mode.Under ＂the Belt and Road＂ initiative,legalization becomes the need for China to enhance the discourse rights to formulate rules.On the basis of analyzing the system of transport international convention,this paper makes comparisons on the international conventions in maritime,aviation and railway,and studies the differences of the conventions from the aspects of national territorial sovereignty,safety of transport process,nationality of traffic ways and law categories,so as to provide study references for transport globalization development in China.
