司法改革视阈下人民陪审员参审范围的改革与重塑

为了进一步体现司法民主,本轮司法改革扩大了人民陪审员的参审范围。参审范围的总括性规定较为广泛,力图扩大陪审员参审范围;原则上参审类案件的文本表达尚且模糊,并且遗漏了死刑案件;当事人申请参审类案件的裁量权在于法院。应当在平衡司法民主与司法效率的基础上,基于陪审必要性考量将参审范围限于重大复杂案件;具体区分为原则上适用人民陪审员参审案件和被告人选择是否启用人民陪审员参审案件两大类;并且应当明确审判组织构成不合法的程序性后果。
