我国孝道文化传统下儿童权利观念发展的障碍与出路

The Obstacles and Ways of Realization of Children's Rights in the Cultural Tradition of Filial Piety

儿童权利的观念源自于西方,我国传统文化并没有孕育出儿童权利的观念,这是因为我国孝道文化传统形成了对儿童的压制,也在根本上成为儿童权利在我国发展的传统障碍。为了使儿童权利观念在我国孝道文化背景下获得较好的认同和发展,从外部的发展路径进路而言,一是需要改造我国的孝道文化传统;二是需要强化儿童权利的"母体"观念,即权利的观念。从内部的发展进路而言,需要深刻认识儿童权利话语的限度、儿童权利概念内在的矛盾以及成人视角的限度等问题,并寻求儿童权利观念发展的有效路径。

The concept of children, s rights comes from the west; the traditional culture of our country does not give birth to the concept of children’ s rights,because cultural tradition of filial piety of our country has formed the suppression on children, and fundamentally become the traditional obstacles of the development of children,s rights in our country. In order to make the concept of children ’ s rights get better recognition and development in the context of cultural tradition of filial piety, one is the need to reform our cultural tra-dition of filial piety from the external development path; second, the concept of rights needs to be strengthened. From the internal development path, we need to deeply understand the limits of children,s discourse or rights, the internal contradictions of the concept of children,s rights and the limitation of adults perspective, and seek the effective path for the development of children, s rights.
