德国专利代理制度的现状及启示

German Patent Agency Institution Characteristics and Implications

我国知识产权事业蓬勃发展,但现有专利代理制度存在一些问题和不足。专利代理制度起源于以德国为代表的发达国家,其关于专利代理人资格考试制度、专利代理行业协会的职责和地位等规定都较为完善。本文以德国专利代理制度的现状和特点为研究对象,对其进行梳理和分析,在此基础上,为我国专利代理制度的发展提出建议。

With the development of China’s intellectual property career, there are some problems and deficiency in the actual institution of patent agency. The institution of patent agency origins from German and some other developed countries, the provisions about the institution of qualification tests of patent agent, and the obligation and status of patent attorneys’ association can be perfect. With the German patent agency institution as the research object, this thesis does analysis and summarization on the patent agency institution, the advices for our country’s patent agency institution are proposed.
