少数民族语言法庭翻译制度既是少数民族语言权在司法领域的重要体现,又是保证充分的法庭交流和对话、实现公正裁判及保持少数民族传统文化生命力的重要手段。当前,我国少数民族语言法庭翻译的实际状况并不尽如人意,除普遍缺乏保障少数民族语言权的理念以外,还与立法技术及跨文化翻译本身难以克服的"文化失真"现象有关。对此,需要从理念培养、制度完善及文化保真等多层面入手来实现少数民族语言法庭翻译制度的特殊价值。

The court interpretation system for minority people represents not only the protection of the lin-guistic human rights of minorities, but also the important means of ensuring fruitful court communication, of ascertaining fair judgment, and of preserving life force of local culture in minority areas. However, the current practice of court interpretation for minority people is not satisfactory. There is a lack in nurturing necessary concepts for protecting the linguistic human rights of minorities, a failure in building the lin-guistic human rights of minorities in legislation per se, and a loss of cultural identity in cross - cultural interpretation. Thus, the intrinsic legal value of the court interpretation system for minority people must be achieved by the concept building, the system improvement, and the cultural identity preservation.
