从性恶论看犯罪之源

On the Source of Crime from the Doctrine of Evil Human Nature

性善论与性恶论倾向的犯罪归因比较在学术界一直未有定论,犯罪原因得不到确认,犯罪预防自然无从谈起。为此,本文就性善论与性恶论的犯罪归因进行比较,结合青少年犯罪和暴力犯罪等不法行为,得出观点——性恶乃犯罪元凶,并基于此探讨犯罪防控及机制构建。在宏观层面,加强人与社会的联系;在微观层面,从犯罪原因着手,对症防控,减少犯罪现象的发生,营造良好的社会氛围。

The question that the attribution of crime is doctrine of good human nature or bad still remains disputable in academia. Without such a verdict, the research of the crime prevention will be hard to make any progress. For this reason, the essay will analyze the comparison of the two attributions of crime, combined with youth crime and violent crime and finally reach the standpoint that the evil human nature is the headstream of crime. Moreover, based on this point, this paper is aimed to discuss and try to build the construction of crime prevention, to strengthen the connection between humans and society, and to reduce crime starting with the source of it from micro lever from the micro level. Only in this way can we create a good social atmosphere.
