中国文化产业立法模式的选择当借鉴文化产业强国立法之成功经验。目前世界范围内存在着以亚洲国家为代表的专门立法以及以欧美国家为代表的分散立法两种模式。鉴于国情和实际需要中国文化产业立法应以"文化强国"为指引,坚持"立法基本原则+立法基本方针+立法技术规范"三位一体的立法原则,按照以文化产业基本法为基础、文化产业单行法为补充的基本进路,选择专门立法这一立法模式。

To choose a proper legislation mode of the cultural industries in China,we can learn the successful legislative experience from the nations whose cultural industries develop very well. There are two major legislative modes of cultural industries in the world： one is the special legislation represented by Asian countries; the other is the decentralized legislation represented by Europe and the United States. Considering the specific national conditions and actual needs of china,the cultural industry legislation should stick to ＂cultural power＂as the guide,adhere to the legislative principle of the Trinity which includes basic principles of legislation,basic policy on legislation and legislative technical specifications. Cultural industries legislation of our country should choose the special comprehensive legislative mode,in accordance with the basic law of the cultural industries as the foundation,and the cultural industries single line law as a supplement as the basic approach.
