论我国宪法中基本权利的“级差”与“殊相” 被引量:15

A Study on " Graduation" and " Particular" of Fundamental Rights in Our Current Constitution

摘要 规定在宪法中的权利虽然都可以称为基本权利,但在我国现行宪法文本中,权利却存在着"级差"和"殊相":从是否与法律规定和现实条件相关而言,基本权利可以分为不受限定的权利、受法律限制的权利和附条件的权利三类;从权利的来源而言,有源于地位的权利和满足利益的权利之分;从权利的属性而言,有消极权利和积极权利之别;从主体的样态来说,有人的权利和作为法律身份、法律角色者的不同权利。 Although constitutional rights can be called the fundamental rights,they contain"graduation"and"particular"in our current constitutional text: the fundamental rights can be divided into three categories of unrestricted rights,restricted rights by law and conditional rights by the legal provisions and the relevant realistic conditions; two categories of the rights from the status and the rights to meet the interests by the source of the rights; two categories of negative rights and positive rights by the property of the rights; three categories of personal rights,the rights of legal identity and the rights of legal role.
