“互联网+”时代众筹融资法律监管之探析

On Legal Supervision over Crowdfunding in the Era of“Internet+”

"互联网+"时代催生了互联网金融的快速发展,而众筹融资作为互联网金融的一种新的形态,因某些方面与现行监管制度的不相容,致使其中存在着信息不透明、非法集资界限不明确等诸多风险,迫切需要予以制度上的回应。在对众筹融资进行界定,及对我国众筹融资的发展现状进行分析的基础上,重点针对众筹融资在法律监管方面存在的问题,从法律监管的体制、制度,以及法律责任等方面提出了相应的对策及建议。

Benefiting from the era of Internet＋,Internet finance enjoys a rapid development.As a new form of Internet finance,due to its incompatibility with the existing regulatory system in some aspects,crowdfunding has been identified with many risks such as non-transparent information and unclear definition of illegal fund-raising.Thus,institutional responses are desperately needed.By defining crowdfunding and analyzing the development status quo of crowdfunding in China,the problems of legal supervision encountered by crowdfunding are pointed out,and corresponding countermeasures and suggestions are proposed in the areas of legal superision regulation,system and legal responsibility.
