Analysis for the Reform of European Patent Organization to Its Appeal Department

欧洲专利组织于2016年6月通过了针对其上诉委员会的机构改革方案,将原隶属于欧洲专利局的上诉委员会独立出来,设置为欧洲专利组织上诉委员会部门(BOA Unit),并于2016年12月15日任命了部门首任主席,旨在提高上诉部门的司法和管理独立性。欧洲专利组织此次改革正值欧洲单一专利即将实施的关键阶段,其深层次的原因在于保证欧洲专利组织在单一专利制度的框架下仍具备竞争力。

In June 2016, the structural reform proposal regarding the Boards of Appeal was approved by the European Patent Organization, in which, the Boards of Appeal which belonged to the European Patent Office is currently a separate department of the European Patent Organization, namely the BOA Unit. The first President of the Unit was appointed on 15 December 2016.The purpose of this reform is to increase the judicial and managerial independence. The timing of this reform happens to be the crucial stage before the implementation of the Unitary Patent. The deep-seated reason is to ensure the European Patent Organization remain competitive under the framework of the Unitary Patent System.
