作为人类的一种基础思维方式和基本认识工具,类型化分析是GUI外观设计专利相关问题研究的重要方法。根据GUI生成软件的不同,GUI外观设计可以类分为系统软件GUI和应用软件GUI。两种GUI外观设计类型与硬件电子产品之间的亲疏关系不同,因而两种GUI外观设计专利在侵权认定和损害赔偿数额计算方面均有不同,特别是应用软件GUI外观设计专利的保护需要产品概念的新解释。

Depending on the type of software, the GUI design can be divided into operation system software＇s GUI and application software＇s GUI.The relationship between the two GUI design types and the hardware electronics are different, so the two GUI design patents are different in terms of the infringement and the amount of damages.In particular,the protection of the application software＇s GUI design patent requires a new interpretation of the product concept.
