摘要
1871年《专卖简则》的颁布启蒙了日本的专利制度,创造性作为专利制度的重要组件,其产生、发展和变迁与专利制度的完善及日本的经济发展密切相关。笔者从法律层面和实务层面分析了日本创造性的变迁历史,对比美欧等国家和地区的创造性变迁,体现了创造性审查标准作为政策杠杆的调整作用,以期为我国创造性的审查评判提供借鉴性意见。
The patent system of Japan is enlightened by Japanese Patent Law in 1871. The concept of inventive step is an important part in the patent system. The development of inventive step is closely related with the development of the patent system and economic. This paper reviews the origins and the changes of inventive step in Japan and other countries, and points out that the leverage of the standards of inventive step to make reasonable modification proposals for our country.
