摘要
住宅建设用地使用权自动续期问题在自身规范缺失的情况下,以《物权法》第149条第1款的理解,可借助宪法规范而获得可能的解释路径。宪法视阈中住宅建设用地使用权自动续期的解释路径可以公民的财产权、住房权、平等权等宪法权利为切入点,寻求宪法权利的实现与既有土地制度框架体系的契合点。这就要求从理论上调适土地公有制与财产权之间的关系、国有土地有偿使用原则与公民有权以合适的价格获得住房之间的关系,并兼顾权利主体之间使用住宅用地的公平问题。
On the condition of rule lacking of automatic renewal of the right to use land for construction for dwelling houses, the constitutional norms can help interpreting the provision on the basis of the paragraph 1 of article 149 in the property law. From the constitutional perspective, to interpret automatic renewal of the right to use land for construction for dwelling houses concerns the right to property, the right to adequate housing and the right to equality. The key is to find the point which can be used to well connect the constitutional rights and the land law framework. Therefore, it' s important to re-understand the relationships between the public ownership and the right to property, the principle of paid utilization of state-owned land and the right to adequate housing that requires the price of housing should be appropriate. Besides, it should be fair enough to all of subject who use the residential land.
