行为法律经济学是融合法学、经济学与心理学的一种综合分析方法,被认为是法律经济学的前沿领域。对这一领域,法律经济学研究者皆知美之为美,并在十年间进行了诸多介绍,但却极少有学者尝试运用这一最新方法对部门法具体问题展开分析,仅有的分析也表现出了诸如未能衔接法律经济学经典理论、分析参数有限、分析工具的适用零散且随意以及行为分析缺乏准确性等问题。究竟如何使用行为法律经济学分析方法研究部门法问题、进而促进法律经济学的"转型升级"?学界对此仍莫衷一是,亟待整合、提炼出相对完整的分析范式。

Behavioral law and economics is a comprehensive analytical method of law, economics and psychology, whichis regarded as the front field of law and economics. In this field, researchers are aware of its significance, and has carried on alot of introduction in ten years, but few scholars have tried to use this new method to analyze the specific problems of the de-partment law. The only analysis also shows such problems as the lack of convergence of the classical theory of law and econom-ics, the limited analysis of parameters, the application of analytical tools, and the lack of accuracy of the analysis and so on.How to use behavioral law and economics analytical method to complete the legal economic ＂upgrade＂ and whether to employthe new tool into the legal analysis of ＂productive force＂？ Scholars are still unable to agree with each other. It should be inte-grated to extract the relatively complete analytical paradigm. This paper is to take P2P company information disclosure obliga-tions as an example.
