试论发展我国低碳经济的法律保障

On Legal Protection of Developing a Low Carbon Economy in China

低碳经济的发展导致了一场全新的能源经济革命。加强低碳经济法律保障是促进低碳经济健康、持续发展的有效手段。审视低碳经济的发展并结合我国的实际情况来阐析我国加强低碳经济法律保障的价值层面和实践层面的内蕴,具有十分重要的理论和现实意义。我们必须从发展规划、产业调整、财政金融、能源和科技等立法方面,借鉴国外低碳经济相关立法的经验,进一步省察我国低碳经济立法的现状,并加以补充和完善,以构建我国低碳经济的法律体系,完善低碳经济的法律保障。

Low carbon economy development led to a new energy economic revolution.Strengthening legal protection of low carbon economy is an effective means of promoting the healthy and sustainable development of low carbon economy.It is of great significance theoretically and realistically to examine the development of low carbon economy and to expatiate on the implication of the value and practice of strengthening legal protection of low carbon economy based on practical situation in China.We must start from legislation on development planning,industrial adjustment,finance,energy and technology,draw lessons from foreign countries on legislation of low carbon economy,examine further the current situation of low carbon economy legislation in China,then supply and complete in order to construct a low carbon economy legal system and to improve legal protection of low carbon economy.
