The Effective Construction of Chinese Social Rules Consciousness

规则意识是规则建构和有效运作的思想基础,规则意识的形成过程是规则的内在化、社会化过程。培养国民的规则意识对于建设法治中国是十分必要且意义重大的。要建构中国社会的规则意识,不仅要厘清规则意识的内涵,理解规则意识形成的内在机制和外部因素,也要力图扫除法律工具主义和机会主义对当下中国规则意识建构形成的障碍;要进一步结合中国社会转型实际,通过现代法治文化的建设,最终在传统法律文化向现代法治文化转型过程中实现规则意识培育的良性机制。

Rule consciousness is the ideological basis of rule construction and effective operation, and the forming process of rule consciousness is the inherent and social process of rule. It is necessary and significant for developing the rules consciousness of the people. To construct the rules consciousness of Chinese society, it is nec- essary to clarify the connotation of the rules consciousness, understand the inner mechanism and external factors of the rule consciousness; in addition, we should try to remove the barriers to the construction of Chinese rules and ideologies by legal instrumentalism and opportunism. China＇s realistic social transformation should be taken into consideration, and the construction of modern legal culture should be depended on so as to establish the virtuous mechanism of the cultivation of rules consciousness in the process of cultural transformation of traditional legal cul- ture to modern rule of law.
