摘要
教育纠纷呈现出显著的复杂性和专业性,仅依赖于传统的教育权利救济方式已无法满足发展教育和保障人权的需要。整合我国以往设置教育类法庭的相关模式及其经验教训,借助我国设置其他专门审判机构的成功实践,可以实现我国教育类法庭的统一设置与管理。将教育类法庭统一命名为"教育法庭",由其运用"三审合一"的审判机制审理教育纠纷案件,能够充分彰显我国教育司法走向公正化、专业化的信心。
Because of the obviously complex and professional problems in educational disputes, the traditional education-right remedy has not met the needs of the development of the education and the protection of the human rights. In order to construct the country under the value of law, China should establish the special "educational courts" in our court system by integrating relative models and experiences of educational tribunals. The target can be achieved by not only searching the specific problems between law and education, but taking the advantages of experiences of other trials. With the help of "the unity of three traditional trial models" , the confidence of the educational judicature will be showed fully.
