《人民警察法(修订草案稿)》关于保障制度的规定,既要服从服务于公安执法实践的现实需要,也要贯彻实施依法治国方略的客观要求,这样才能使立法稳当可靠、结构层序分明和保障恰到好处。只有通过逐条进行解析,才能确定修订草案稿警务保障方面的规定是否适应新形势新任务提出的新要求新挑战。

The security system should not only serve the practice of public security law enforcement, but also carry out the objective requirements of the strategy of running the country according to law, so as to make the legislation sound and reliable.Only through the analysis can we draw the conclusion that the provisions of the revised draft will meet the new requirements and challenges. This paper focuses on the necessity, legitimacy and defects of the duties exemption, law enforcement, violent attacks on police interference, auxiliary system and relief system stipulated. Meanwhile, some suggestions are put forward, such as amending the structure of the law, increasing judicial relief and drawing on experience.
