“三权分置”下的农村土地经营权研究

The Research on the Right of Management of Agricultural Enterprises under the“ Separation of Land Rights”

当前,随着《关于完善农村土地所有权承包权经营权分置办法的意见》的出台,我国农村土地承包经营权正在经历继家庭联产承包责任制后的又一次改革,主要目的是在"三权分置"前提下推进土地向规模化、现代化的农业经营主体流转,将土地经营权从土地承包经营权中分离出来形成经营主体的合同权益,具有相对独立性和较大自主性,有利于对土地的合理利用。经营主体要坚持依书面合同确定权利义务关系进行流转、充分发挥土地使用价值以及与农户互惠互利原则,逐步向规模农业、现代农业以及市场经济发展,推进我国城乡一体化建设。

At present, China＇ s rural land contracting fight is undergoing another important reform after household contract responsibility system. The main purpose is to promote the transfer of land to large - scale and modernized agricultural enterprises under the precondition of ＂ separation of land rights＂. The right of management of agricultural enterprises separating from rural land contracting right, with relative in- dependence and greater autonomy, is helpful to the rational use of land. Agricultural enterprises should in- sist on setting the circulation right in accordance with the written contract, fully take advantage of the land and make the farmers getting more benefit. For the purpose, agricultural enterprises must develop towards the scale of agriculture, modern agricuhural system and market economy development, in order to promote China＇ s urban and rural integration
