建筑设计作品不是建筑实用功能的随机罗列,更不是毫无智力的创造,它是融入了设计者思想观念的作品,具有独创性和美学价值。文章将运用概念法学的相关原理,全面梳理建筑设计作品上的知识产权,并通过比较分析,探索出对建筑设计作品的最佳保护方式。
Architectural design work is not a random list of building practical function, even not the creation of the intellect, which is the work blended in the designer＇s ideas, has the originality and aesthetic value. This article will use the concept of law related principles, comprehensively combing architectural design work on the intellectual property rights, and through the comparative analysis to explore the best way to protect for architectural design work.
