商品房消费纠纷型群体性事件成因及预防范式重构——基于重庆市内案例的实证分析

Causes and Prevention Model Reconstruction of Commercial Housing Consumer Disputes Group Events: Based on the Empirical Study of Cases in Chongqing

通过对重庆市商品房消费纠纷型群体性事件的实证考察,发现该类群体性事件的主要特点包括:发生频率呈地域发展相关性、小区规划不当或房屋质量不过关为主要诱因、主要表现形式为聚集示威、部分事件具有反复性。当前,对该类群体性事件的预防存在的问题包括:现行相关法律缺乏针对性、对购房业主表达利益诉求的权利保障不足、商品房消费纠纷调解过程的定向公开机制不够完善。由于现有一般意义上的群体性事件预防范式对商品房消费纠纷型群体性事件缺乏针对性,应该通过在信访制度框架下完善购房业主利益诉求表达机制、推动商品房消费纠纷调解过程对利害关系人的定向公开、强化对具有反复性的商品房消费纠纷型群体性事件的管控,重构商品房消费纠纷型群体性事件的预防范式。

The features of commercial housing consumer disputes group events are revealed as the following based on the empirical study of cases in Chongqing： regional frequency, improper district planning or unqualified building quality as main incentives, mass demonstration as major patterns and repetitive events. At present, there are some problems in the pre-vention of this kind of mass incidents. Current laws lack pertinence. Owners ＇ right to express interest appeal has not been guaranteed. The Publicity of commercial housing consumption dispute mediation process is not enough. Because a general sense of group events prevention model is not suitable for this kind of events, perfecting house-purchasers ＇ interest expression mechanism under the framework of petition system, promoting directed publicity of commercial housing consumption dispute resolution to the interested party and strengthening the control of repetitive events should be implemented to recon-struct the prevention model.
