警察权有效外部监督:机制选择的进路

Effective External Oversight of Police Power: Selection Approach

我国警察权在国家权力框架中扮演着十分重要的角色。警察权既带有行政执法的性质,又不乏刑事司法的色彩。就监督国家权力的角度而言,外部监督比内部监督更具有约束力。然而,目前对我国警察权仍然缺乏一个相对完善的外部监督机制。其中,构建对不依法履行警察权的机关的罚款和晋升考核机制、国务院对省级投资和拨款机制是警察权外部监督制度选择进路的两架"不可或缺的马车"。同时,从机制上对警察权实行外部监督可以将法治警察建设和法治中国建设有机结合起来。

Police power in China plays a very important role in the framework of state powers. Police power is with the nature of administrative law enforcement and full of criminal justice color. From the perspective of state power over-sight, external oversight is more binding than internal supervision. However, current police power in China still lacks a rel-ative perfect external oversight mechanism. Among them, there are two basic approaches. The first is to build fine and pro-motion assessment mechanism for organs which do not perform police power. The second is the State Council ＇s investment and funding mechanism for provinces.Meanwhile, external supervision mechanism to police power can combine the con-struction of ruling China by law and ruling police by law.
