规范和限制视角下看警察的维权问题

Research on Safeguard of Police's Legal Rights from the Perspective of Specification and Limitation

我国法治建设取得了巨大的进步,2012年新的《刑事诉讼法》颁布实施,既完善了侦查机关的侦查行为和手段,又强化了对侦查行为的规范、制约和监管,这就说明在社会主义法治理念要求下,公安机关必须做到执法为民和公平正义。同时,人民警察的维权问题对于加强民警队伍的战斗力、维持社会的和谐安定和惩治违法行为都具有重要意义。近年来,治安、交管和刑警等一线执法民警在执法时遭遇暴力抗法和侮辱诽谤的现象频发,应寻求解决之道。

The construction of law in China has made grea t progress. The enactment and implementation of new criminal procedure law in 2012 not only perfect detection behaviors and measures of investigative organization, but also strengthen the regulation, restriction and supervision, which indicates that police agency must enforce the law for people and maintain fairness and justice with socialist concept of rule by law. At the same time, safeguard of police ＇s legal rights is of great significance to strengthening police ＇s combat effectiveness, keep harmony and stability of society and punish illegal behavior. Solutions should be found to curb the frequent violent resistance against law and insult and slander the front-line police face in law enforcement.
