博弈背景下群体性涉法闹访及其执法优化

Group Events of Trouble Petition Involving the Law and Its Enforcement Optimization in the Context of Game Theory

当前基层社会治理中,不断出现群体性涉法闹访事件。原本应由司法机关或法定行政机关处理的案件,却通过群体聚集的方式向党政机关抗议以图解决,将案件演变为事件。党政机关的主政官员在社会稳定效用函数的制约之下,借助其综合协调能力和财政调拨权力迅速处理事件并给予补偿,把事件转化为案件。运动式执法的背后是博弈的结果。当事人通过群体闹访参与了博弈竞争,介入了主政官员与上级机关的长期博弈关系中,改变了主政官员的支付函数,当事人实现了利益诉求。这一维稳机制具有制度的自毁性,破坏了基层法治,向外界释放了政府权力商品化的信息。因此,需要改革基层治理综合评价指标,重塑科层强激励;吸纳公众参与危机事件治理,营造党政系统的符号资本;疏通商谈渠道,实现访民的分类与社区治理制度的完善。

In the current grassroots social governance,group events of trouble petition involving the law are continuing to occur. The case should be handled by the judiciary or administrative organs,but through the group gathered to the party and government organs to protest,causing the case to evolve into an event. Under the constraints of the function of social stability,officials of the party and government organs get help with its comprehensive coordination and financial allocation of power to deal with the incident quickly and give compensation to the relative person,which turn the event to the case. Behind the motion law enforcement is the result of the game theory. The parties involved in the trouble petition involving the law through group prayer,entered the long-term game relationship between the principal officials and the higher authorities,changing the payment function of the principal officials,thus realizing the interest demands.This mechanism of stability has a system of self-destruction,undermining the grass-roots rule of law,releasing the information on the commercialization of government power to the outside world. Therefore,it is necessary to reform the comprehensive evaluation index of grassroots governance,to rebuild the strong incentive of the grassroots level,to attract public participation in crisis management,to create the symbolic capital of the party and government system,to clear the channels of consultation,to realize the classification of the visitors and the improvement of the community governance system.
