论鉴定纠纷的特征、类型与防控机制--以民事当事人与社会鉴定机构及其鉴定人的纠纷为视角

The Characteristics, Type, Prevention and Control Mechanism of Appraisal Dispute--From the Perspective of Disputes between Civil Litigant and Social Appraisal Institution and Appraiser

在我国民事司法实践中,当事人与社会鉴定机构及其鉴定人之间就相关鉴定问题频发纠纷或冲突并影响到民事审判与民事鉴定的良性运作。就当前来看,民事司法中的鉴定纠纷具有相对独特的案件结构特征与多元化的类型特点。鉴定纠纷导致的种种消极性后果,要求国家采取系统性的防控机制,规范法院与法官的涉鉴行为与社会鉴定机构及其鉴定人的违法违规行为;同时,针对当事人不尽合理乃至违法的维权救济措施,国家同样应该采取严厉制裁。

In civil cases, disputes or conflicts regarding appraisal issues between civil litigants and social appraisal institutions and appraisers often arise, which affects the civil trial and operation of civil appraisal. At present, the appraisal disputes in civil cases have the characteristics of a relatively unique case structure and diversified types. The negative consequences caused by appraisal disputes require the authority to adopt systematic prevention and control mechanism, to regulate the court and the judge＇s behavior, and to control social appraisal institutions and appraisers＇ violation. At the same time, for the unreasonable or even illegal relief measures by the parties in civil cases, we should also take tough action.
