党内法规清理标准的科学化构建

Scientific Building of Standards of Checking Party Rules

党内法规清理标准既是进行党内法规清理的核心依据,也是完善党内法规体系的有力推手。现行党内法规清理标准存在制度基础不足、审查能力弱化等缺陷,无法化解党内法规体系中存在的内部难题,亦难以满足协调国家法律体系的客观需求,亟需对之进行完善。科学的党内法规清理标准有助于实现党内法规内部的耦合,促进党规与国法的兼容,保证党内法规与社会发展相适应。在党内治理法治化背景下,应建立一个以政治性审查为前提、以合法性审查为着力点、以合理性审查为重要补充的科学完善、运行有效、开放多元的党内法规清理标准。

Standards of Checking Party rules are not only the core and basis for carrying out the work of checking Party rules, but also the great driving force. With weak ability of checking, the existing standards are in lack of the basis of system. The problems in the system of Party rules can not be solved. And the need to coordinate the national law system can not be satisfied. So the standards need to be improved. Scientific standards of checking Party rules help to realize the interconnection of Party rules, promote the compatibility of Party rules and national laws, and ensure that Party rules adapt to the social development. With the legalization of Party governance, standards of checking Party rules need to be established which are scientific, effective, open and multiple.
