Hotspot and Difficult Issues in Judicial Practice of Internet Infringement of Right of Personality

随着网络的发展以及《最高人民法院关于审理利用信息网络侵害人身权益民事纠纷案件适用法律若干问题的规定》的出台,网络侵犯人格权案件日益增多,新问题不断涌现。本文以海淀法院审理的网络侵犯人格权案件为研究样本,就此类案件审理中的热点、难点问题进行了梳理,以期有益于理论研究和司法实践。

With the development of internet and the issuance of＂Provisions on Several Problems of How to Apply the Law to the Civil Dispute Cases of Infringing Personality Rights with Information Network of the Supreme People＇s Court＂,cases of internet infringement of personality rights are increasing day by day and new problems continue to come forth.In this article,cases of internet infringement of personality rights tried by the Court of Haidian District are be regarded as research samples,the hot and difficult problems in the trial of such cases are tidied up,and this research is expected to be helpful to theoretical research and judicial practice.
