摘要
《互联网广告管理暂行办法》的出台因应了互联网广告特点,直面互联网广告监管的难题,具有积极价值。从价值目标而言,政府对互联网广告监管本质上是对言论的一种限制,需要遵循依法行政原则、比例原则,平衡好公民的言论自由与国家利益、公共利益的关系。《办法》属于部门规章,权限范围有限,需要处理好与《广告法》《行政处罚法》《网络交易管理办法》等法律规范之间的关系。
Interim Regulation for the Administration of Internet Advertising responds to the characteristics and difficult regulatory problems of Internet advertising,which has a positive value.In terms of the goal,the government supervision over the Internet advertising is essentially a limitation of speech,should abide the principle of administration by law and the principle of proportionality,and balance the citizens' freedom of expression with the state interests and public interests.The Regulation which belongs to departmental regulations,has a limited jurisdiction scope,needs to handle the relationships with other legal norms,such as Advertising Law,Administrative Sanction Law,Regulation for the Administration of Network Transaction.
