随着新闻传播事业的发展,因新闻引起的名誉侵权纠纷相应增多,但新闻作品中使用语言修辞引起的名誉侵权纠纷,司法实践中还存在着模糊认识,从而导致在实践中界限区分不明。本文对新闻作品的创作规律及名誉侵权的构成要件进行分析,以明晰其界限。

With the development of journalism, the dispute of reputation tort caused by news has increased greatly in number. However, in judicial practice, there exists a confused ideas about the reputation tort caused by the language rhetoric in news report. This paper analyses the writing principles of news report and the elements of reputation tort.
