摘要
《物权法》对指示交付作了相关规定,但并未明确阐明指示交付的成立要件,由此引发种种学术纷争。在指示交付的构成要件中,让与通知承担何种角色?对于指示交付的完成起到何种作用?让与通知在指示交付中发生了什么法律效力?这些问题在学界都产生一定分歧。作为观念交付的方式中的一种,指示交付对财产的流通性起到了良好的促进作用,加速了财产交易,随着指示交付应用面的不断拓展,其地位会不断提升。因此,厘清指示交付的一系列问题对制度的适用有所裨益。
Regulations on the indication delivery in property law is not clear about the essential elements Which caused a variety of academic disputes. Should instructions included in the components of indication delivery or not? what is the legal effect of the assignment notice in indication delivery? There are certain difference in academic field. Indication delivery, one of the substitute for delivery form,accelerating the property deal. With the development of economy, the status of it will continue to ascend. It is beneficial to the application of the system if clarify a series of problems about indication delivery.
