民国贵州法律文化研究

The research of the legal culture of Gui Zhou Province In the Republic of China

本文通过对民国大定县司法档案的统计分析,以期得到民国贵州法律文化的一个有力例证。先是对案卷进行统计,分为民事类案件统计结果、刑事类案件统计结果,以及民事、刑事共同的统计结果,最后是其他的材料总结。然后在此前统计的基础上,得出一些直观的结论,比如司法人员工作情况、判决执行情况等。最后是更进一步升华提炼,进行理论的总结,脱离碎片化的直观研究,通过本文的研究,以期对民国贵州法律文化有一个较客观的描述。

Based on the statistical analysis of Da Ding county＇s judicial archives in The Republic of China, this paper aims to get a powerful example of legal culture in Guizhou Province. It firstly makes a staticstic analysis of the records, which include statistical results of civil cases, criminal cases, and civil and criminal cases combined; and then it is the summary of other materials. After that on the basis of the previous statistics, some intuitive conclusions, such as the judicial personnel work, and ruling execution situation, etc. are acquired. The last part is further refining and summarizing of the theory; that is visual observation seperated from the fragmentation. Through the study of this thesis, the author aims to have a comparatively objective description of the legal culture of Guizhou Province in the Republic of China.
