论我国作品完整权侵权认定标准——基于《鬼吹灯》电影改编案的思考

On the Infringement Standards to the Integrity Right of Works——Reflections on the Film Adaptation of Adventures of Three Tomb Raiders

我国现行法对作品完整权的规范较为模糊,如何理解"歪曲、篡改"是侵权认定的关键。基于"歪曲、篡改"是否包括"损害作者声誉"客观结果的观点分歧,司法实践中将侵权认定标准分为主观标准与和客观标准。主观标准认为无需损害结果,只要违背作者愿意便可认定侵权,此标准容易造成权利的滥用;客观标准根据"损害作者声誉"的客观损害事实来判定侵权行为,此标准可能与作品完整权的功能产生冲突。有鉴于此,结合我国实际情况,应选择"主观过错认定为主,客观损害判断为辅"的侵权认定标准。

There is only a vague definition and identification of “ the right of integrity” in current Chinese law,and the key of in-fringement cognizance lies in the interpretation of “ distortion and tempering”. Because of viewpoint divergences whether “ distor-tion and tempering” includes objective results of “ reputation damage to the author”,the identification standards in judicial prac-tice are divided into a subjective standard and an objective standard. The former one does not demand damage results and in-fringement occurs with the violation of the author,s willingness. This standard is likely to cause abuse of rights. While the later one identifies infringement according to “objective reputational damage to the author”,which may contradict with “ the right of in-tegrity”. In view of this and China’s actual situation,it is suggested that infringement cognizance standards take account of “ the subjective fault identification” in the first place,followed by “ the objective damage judgment”.
