我国作品登记工作的成效与问题研究

On the Successes and Problems of Works Registration in China

近年来,我国作品登记工作取得明显成效,登记数量大幅增长,作品登记对版权保护和产业发展的支撑作用日趋显现。然而,我国作品登记工作实践中也还存在一些困境。为提升作品登记效用,我国应当在《著作权法》第三次修订时增设关于作品登记的一般性规定,明确作品登记的法律性质和登记证书的法律效力;可以制定和实施作品登记公共服务标准,促进作品登记工作的规范化发展;可以增设作品登记审查建议书制度,提高作品登记公共服务资源的利用效益。

With the increasing number of registered works in recent years, works registration enjoys great achievements in Chi-na, and plays an increasingly important role in copyright protection and copyright industry development. However, problems and difficulties still come up in works registration practice. To promote its development, the system of works registration needs further improvements, to add general provisions in making the third revision of Copyright Law. These general provisions should provide legal support for works registration, clarify the legal nature of works registration,and confirm the legal validity of works registra-tion. Standardizations for works registration public services should be formulated and implemented. A proposal system of works registration is necessitated to improve public service effectiveness of works registration.
