"专利流氓"是市场经济的产物,其存在和发展符合市场竞争规律,美国高智发明(Intellectual Ventures,IV)和Vringo等"专利流氓"公司以及大量专利诉讼案件的出现证明其具有强大的生命力,是专利运营模式的一种创新。运用"鲶鱼效应"理论,从"专利流氓"激励专利运营、盘活专利资源和提高企业创新能力的视角阐述其带来的正面影响。建议我国中小企业在面对"专利流氓"时持辩证和理性的态度,并建议我国立法、司法和行政机关协同合作来制约"专利流氓"滥用专利权利的现象。

Patent trolls are the product of a market economy, and it exists and develops in line with market rules of competition. Patent trolls are bold and innovative business model patents. In the United States, a large number of patent litigation cases emerged, for instance companies such as Vringo are catching eyes, which demonstrated its strong vitality. In this paper, based on ＂catfish effect＂ theory, from the perspectives of motivating patent rogue operators, utilizing patent resources and enhancing innovation capability, the paper elaborates positive impact of patent rogue. Finally the paper suggests that SMEs in the face of rogue should hold the dialectical and rational manner, and legislative, judicial and administrative authorities should collaborate to restrict the abuse of patent rogue phenomenon.
