论“以礼治军”思想及其在当前军事法治建设中的价值

On the Thought of “Disciplining the Army According to Proriety” and its Value in the Current Military Rule of Law

夏商周三代"以礼治军",产生了以军礼作为规范的国家军事法。春秋以降,军礼走向衰落,但内化为民族的精神传统。从"以礼治军"到"依法治军"所反映出的本质是军队内部秩序的重构,而"以礼治军"对"依法治军"有着积极的借鉴意义。依法治军应该强化军事法治建设的道德支撑,加强"军队礼仪"建设,注重思想政治教育,培养权利与义务相统一的军队法治文化,全面推进依法治军建设。

Since the Spring and Autumn period, military proriety headed toward a de- cline, but its ideas were preserved. The relationship between ＂Disciplining the army according to proriety＂ and ＂Running the armed forces according to law＂ must be viewed dialectically, the nature it reflects is the reconstruc- tion of internal military order. ＂Disciplining the army according to proriety＂ is very useful to the current construc- tion of ＂Running the armed forces according to law＂.
