The Legal Issues Related to Coordination Between China and the United Nations in China's Participation in Peacekeeping Operations

从1990年4月至今,中国参加联合国维持和平行动已近30年。按照中国参加联合国"待命部队安排"的机制运作,从中国与联合国之间就中国派遣维持和平人员签署备忘录、任命高级军官、派遣军事观察员和维和民警、组建参加联合国维持和平任务部队、受领任务、提供经费装备、确定作战指挥关系,再到中国维持和平人员的权利(尤其是特权豁免)义务和责任、违法犯罪行为的管辖和伤亡人员的赔偿抚恤,均涉及一系列具体法律问题。为了确保当事各方的利益,对我国参与维和过程中与联合国协调有关的法律问题加以深入研究,无疑具有突出的理论意义和重要的实践价值。

It is nearly thirty years up till now since China participated for the first time in the United Nations Peacekeeping Operations in April 1990. In accordance with the United Nations Stand - by Force Mechanism joined by China, a series of legal issues would arise from coordination between China and the United Nations： Memoran- dum of Understanding, appointment of commanding officers, contribution of military observers and civil police, es- tablishment of peacekeeping forces, acceptance of mandate, supply of equipment, determination of chain of com- mand and so on and so force. On the other hand, it is worthy to analyze further legal issues regarding coordination in United Nations Peacekeeping Operations such as rights, obligations and responsibility of Chinese peacekeepers, jurisdiction over violations of disciplines and law, and compensation for casualties in operations. To ensure interests of all parties concerned, it is of both prominent doctrinal significance and critical practical values to make an in - depth robe in the legal aspects related to coordination between China and the United Nations in China＇ s participa- tion in Peacekeeping Operations carried out by the United Nations.
