渎职侵权犯罪查办之困境及化解——基于中南某地区的实证研究

腐败问题,是当前社会的热门问题、焦点问题,日前,国家正在一些地方开展监察体制改革试点,势必将反贪工作进一步深化。相较于贪污贿赂犯罪而言,渎职侵权犯罪是一种更为隐蔽、更易引起人们认识分歧的腐败行为。调取某地区2008年至2012年五年间的渎职侵权犯罪案例,从立案、侦查、审查起诉、审理判决四个诉讼阶段,展示渎职侵权犯罪的查办现状,并分析了案件办理中存在的问题:从渎职侵权案件查办罪名上看,司法实践适用罪名仅立法设置罪名的三分之一;从案件办理过程看,有效线索来源不足,定罪证据严重依赖于犯罪嫌疑人的供述,非证据原因引起的认识分歧较大;从案件处理结果看,渎职侵权犯罪打击偏离法律轨道。以上问题的产生,有立法与复杂社会生活相脱离的原因,也有司法运行过程中相关制度、机制设置的原因,还有社会认识层面的原因。
