论我国外资准入审批制度改革的完善

On the Improvement of the Approval System of Foreign Investment Access

2016年9月以来,我国对外资准入审批制度进行了重大改革,彻底改变了以往所有外资项目一律须经审批的做法,对未列入负面清单的项目实行备案制,但仍存在审批机构设置不合理、立法缺乏透明度等问题。2015年《中华人民共和国外国投资法(草案征求意见稿)》代表了我国目前外资法相关领域的最新立法趋势,即使是这部尚未通过的草案,也存在上述问题。因此有必要结合2015年《中华人民共和国外国投资法(草案征求意见稿)》中的相关条款,进一步统一外资审批机构、减少审批程序;收回立法权,严格限制审批权;制定明确的审查标准;完善审批救济制度。

As regards our examination and approval system,China has completely changed the previous practice that all foreign projects must be subject to approval since September 2016.The approval procedures of most industrieshave been reduced,but there are still some problems such as irrational review bodies and lack of transparency in related legislation.The Foreign Investment Law of the People's Republic of China(Draft)of 2015,which represents the latest legislative trend in China,still faces the similar problems.Based on the Draft of Foreign Investment Law of the People's Republic of China,this paper provides some suggestions for improving the approval system of China:to unify the examination and approval authorities and to reduce the examination and approval procedures;to recover legislative power,and strictly restrict the power of examination and approval;to formulate clear examination standards and perfect the examination and approval relief system.
