知识产权与一般的财产所有权不同,虽然具有排他性的特征,但无法通过排他占有而直接实现权利人的利益增长。因此,知识产权制度追逐的首要价值,是以"知识"快速增益并促进"知识"快速流转的效率价值,这使得知识产权的权利具有了动态属性,即只有在知识产权转化的情况下权利人的利益才能得以实现。这意味着知识产权制度应当具有法律激励的重要功能。

Intellectual property rights are different from the general property ownership. Thus, the primary value that the intellectual property right system pursues is the rapid gain of ＂knowledge＂ and the efficiency value in the rapid flow of ＂knowledge＂, which makes the intellectual property right have a dynamic attribute, that is, only when the intellectual property rights are transformed, the benefits can be achieved. This means that the intellectual property right system should have an important function of legal incentives.
