腐败犯罪是社会的毒瘤,任何国家都不能彻底摆脱腐败犯罪的困扰。鉴于我国反腐形势的现状不容乐观,党和政府采取的一系列反腐措施大有"乘胜追击"之势。虽然利用刑法惩治腐败犯罪对于遏制该类犯罪起到了一定的积极作用,从严治党以及严格要求国家工作人员符合"为人民服务"的根本宗旨,然而异化了的刑事司法判决并未能有效遏制该类犯罪的蔓延。因此,在当下时期,应当在注重刑法惩处腐败犯罪的同时加大对该类犯罪的事前预防;在刑法反腐的法定刑配置上,继续保留死刑规定不仅不能有效预防该类犯罪,而且与刑法的基本理论相违背,因而在考虑废除腐败犯罪的死刑规定后对其刑罚结构需要进行相应的调整和完善。

Therefore, in the current period, should focus on punishment of corruption crime and increase prevention for this type of crime in the criminal law; statutory penalty of corruption, continue to retain the death penalty provisions not only cannot effectively prevent the crime, and the basic theory of criminal law and violate, so in considering the abolition of the death penalty after the crime of corruption the pen- alty structure needs to adjust and perfect the corresponding.
