During patent review, the debate between the examiner and the applicant is often focused on solving technical problems and unexpected technical effects. By taking a practical case into consideration, this article studies the requirements for the right to use the parameters, the ways to determine the pending technical problems and whether unexpected technical results can be obtained in a bid to determine whether the claims are creative.
