追续权适用范围研究——兼评我国《著作权法》修改草案

Application Scope of Droit de Suite in China——Comments on the Draft Amendment of“Copyright Law”

追续权是艺术家从作品的转售中分享利益的权利。我国《著作权法》第三次修法正在进行中,修改草案新增了追续权条款。除草案第一稿外,其他草案各稿都将追续权适用范围限定于公开拍卖,这引起了拍卖行业的强烈反对。不过,通过对我国艺术市场现状进行分析,可以发现,我国现阶段将追续权适用于其他交易类型不具有可操作性,只有将追续权制度限定于公开拍卖才具有可操作性。未来,我国追续权可以扩展适用于艺术市场专业人员参与的转售活动,以使更多艺术家受益,并平衡艺术市场中介商的利益。

The droit de suite is a copyright for authors of fine art to gain profits from resale.The third amendation of Chinese＂Copyright Law＂is now in the process,and the＂copyright law＂draft amendments introduces the Droit de Suite for the first time in China.Unlike the first draft,the＂copyright law＂draft amendments have limited droit de suite to public auction,which aroused strong opposition from the auction industry.However,by analyzing the status quo of the art market,we find that applying droit de suite to other types of transactions is not operational in China.Currently,droit de suite shall apply to the resale of public auction in China.With the purpose of benefiting more artists and balancing the interests of the art market intermediaries,China should consider extending droit de suite to the resale in which the art market professionals get involved in the future.
