有效辩护在未成年人刑事裁判中的作用

The Role of Effective Defense in Juvenile Criminal Judgment

我国侦查、检察机关因有国家强制力作为后盾而天然的在刑事诉讼中处于强势地位,一定程度上导致被追诉人在刑事诉讼中地位不平等的现象发生,而未成年被追诉人由于自身心智上的原因以及家庭环境问题,更容易受到诉讼地位不平等的影响。"有效辩护"原则能有效的维护被追诉人的合法权益,使被追诉人的辩护权得到合理有效的行使。本文根据我国刑事辩护存在的问题,提出该原则在我国刑事裁判中发挥的积极作用。

The investigation and procuratorial organ of our country is in a strong position in the criminal lawsuit due to the backing of the state coercive force. To a certain extent,the phenomenon of unequal status of the accused in criminal proceedings,and minors accused of their own mental reasons and family environment problems,it is more vulnerable to be impacted by unequal litigation status. The principle of ＂ effective defense＂ can effectively safeguard the lawful rights and interests of the accused person,and make the defendant＇s right to defend reasonably and effectively. Based on the problems of criminal defense in our country,the present article proposes the positive role of this principle in our criminal adjudication.
