政府环境治理责任的冲突与化解——以一次邻避运动为分析案例

生态环境恶化以及由此引发的一系列经济社会问题是环境治理被摆在突出位置的客观原因。就政府而言,环境治理需要不同部门根据自身的权责清单来执行环境治理的各项要求。在一次"邻避运动"的田野调查中发现,政府不同部门职责与功能的差异致使政府环境责任的落实存在一系列冲突。从这一案例出发,讨论由政府部门间矛盾所引发的政府环境治理责任冲突,并从土地伦理与协同治理两个方面探讨责任冲突的化解机制。

As a crucial agenda, Environmental governance has its objective causes which rely on Eco-degradation and series of affiliated problems. For the government, different departments implement diverse policies according to their own responsibilities list to achieve environmental governance. In the field research of a NIMBY protest, it is found that the different responsibilities and functions of different departments can lead to tensions in the implementation of government environmental responsibilities. This paper discusses the dilemma of responsibility implementation caused by the conflicts among departments via this case, and explores a mechanism to solve this problem by land ethics and collaborative governance.
