随着人口老龄化加剧及社会公序良俗形态的变化,特别是在"二孩"政策出台后,一些家庭有生育二孩的愿望,但却因为各种原因无法实现自然生育,因此,选择借助辅助生殖技术实现生育愿望。代孕是辅助生殖相关技术中广受争议的内容,不孕者或已过生育年龄的失独者的正常生育权益和代孕不良伦理后果及权益纠纷之间矛盾重重,如何规避不良伦理后果并满足合理的代孕需求,是当下值得探讨的重点问题。

With the aggravation of population aging and the change of social convention, especially after the introduction of two- children policy, some families wish to have two children can not be achieved due to various reasons. Therefore, they use assisted reproductive technology to achieve fertility aspirations. Surrogate is a controver- sial topic in the assisted reproductive technology, the contradictions between the normal reproductive rights of the infertile woman and the women who have lost their children but passed the age of childbearing and the bad ethical consequences and rights disputes of surrogacy. How to avoid the bad ethical consequences and meet the demand of reasonable smTogate is the major issue worthy to be discussed.
