民商法下的少数民族非遗传承主体权利保障

The Protection of the Rights of Ethnic Minorities' Intangible Cultural Heritage in the Civil and Commercial Law

少数民族非物质文化遗产作为文化瑰宝有着重要的文化经济价值。考虑到非物质文化遗产自身的非物质性以及活态传承的特点,传承主体发挥着重要作用。非物质文化遗产传承主体多数以群体形式存在,一起肩负着非遗传承的重担。当前非遗传承保护面临众多困难,这些都和传承主体权利保护缺失存在紧密联系。不管是国家还是地方立法,对非遗传承主体私权保护较弱,传承主体的权利、地位都难以获得法律救济,因此,从民商法视角下确立少数民族非遗传承主体权利保障机制,有助于提高法律权利保障水平。

As a cultural treasure,the intangible cultural heritage of ethnic minorities has an important cultural and economic value. Taking into account the intangible cultural heritage of the intangible nature of their own,as well as the characteristics of living heritage,heritage plays an important role. In the majority of Intangible Cultural Heritage Inheritance in the form of groups, together shoulder the burden of non heritage heritage. At present, the inheritance of intangible heritage protection is facing many difficulties,which are closely related to the lack of protection of the rights of the subject.Whether national or local legislation,the main transmission of intangible cultural heritage protection of private rights is weak,inheritance rights and status are difficult to obtain legal relief,therefore,to establish the guarantee mechanism of intangible cultural heritage inheritance rights of ethnic minorities from the perspective of civil law,is helpful to improve the security level of legal rights.
